A Procura de Consiliência: O Pedopsiquiatra no Tribunal de Família e Menores

A partir do conceito de consiliência, este artigo trata da transdisciplinaridade entre Justiça e Pedopsiquiatria quando um pedopsiquiatra tem funções de perito no Tribunal de Família e Menores (TFM). A atitude de consiliência do pedopsiquiatra, relevando a relação entre a família no TFM e o campo dos afetos, é analisada tendo em consideração as particularidades do Direito que rege o TFM e as novas conceções sobre as responsabilidades parentais que vieram destronar o poder paternal. O que está em causa é a praxis e competência do pedopsiquiatra como guardião do funcionamento psicológico da criança ou do jovem no TFM.
The Search for Consilience: The Pedo-Psychyatrist in the Juvenile and Family Court
This essay examines the trans-disciplinarity between justice and child psychiatry provided by the concept of consilience, when a child psychiatrist takes the position of an expert in the Court of Family and Minors (TFM). The attitude of consilience of the child psychiatrist, promoting the relation between family in the TFM and the field of affections, is analysed considering the judicial particularities which rule the TFM and the new conceptions of parental responsibilities which have dethroned the paternal power. What is at stake is the praxis and competence of the child psychiatrist as a guardian of the psychological functioning of the child or youth in the TFM.
